A BILL to amend article two, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section two, relating to county transportation director certification programs; program standards; continuing education; and authority to issue transportation certificates.

Be it enacted by the Legislature of West Virginia:
That article two, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section two, to read as follows:
ARTICLE 2. STATE BOARD OF EDUCATION.

§18-2-2. Transportation director certification program; standards; continuing education; authority to issue transportation certificates.

(a) The education and training of all county transportation directors in the state shall be under the general direction andcontrol of the state board of education, office of transportation. The education and training of county transportation directors in the state includes all programs leading to certification to serve in the public schools.
(b) By the first day of July, one thousand nine hundred ninety-four, the state board of education after consultation with the state director of transportation, shall adopt and implement standards and curriculum for the education and training of county transportation directors.
(c) Every certified county director of transportation shall be required to continue his or her transportation education throughout the period of his or her employment as director.
The state director of transportation shall administer the programs of mandatory continuing transportation education and training and shall have the following powers and duties:
(1) To formulate course curriculum, provide course materials and implement the continuing transportation education program.
(2) To determine the number of credit hours to be allowed for each accredited course.
(3) To record and report the number of credit hours earned by each county transportation director to the state board of education.
(d) The state superintendent of schools may issue certificates to graduates of the transportation director education program approved by the state board of education and in accordance with rules adopted by the state board afterconsultation with the state director of education. A certificate to act as a county director of transportation should not be granted to any person who is not a citizen of the United States, is not of good moral character and physically, mentally and emotionally qualified to perform the duties of a county director of transportation who has not attained the age of eighteen years on or before the first day of October of the year in which his or her certificate is issued.



NOTE: The purpose of this bill is to require that all county transportation directors in the state be certified by the state department of education. This bill directs the state director of transportation to adopt and implement standards and course curriculum for the education of all county transportation directors and requires county transportation directors to attend continuing education classes administered by the state director of transportation. This bill allows the state superintendent of schools to issue certificates to graduates of the transportation director education program.
